PocketCHIRP Terms of Service

These Terms of Service ("Terms") govern purchases of PocketCHIRP from pocketchirp.com, use of PocketCHIRP-hosted services, and direct-distribution licensing and activation services. Separate terms and policies from Google may also apply to copies distributed through Google Play.

1. PocketCHIRP and Ongoing Development

PocketCHIRP is radio programming and management software under active development. Releases may contain bugs, incomplete features, compatibility limitations, or behavior that changes between versions as support for radios, connection methods, and other features continues to evolve.

Compatibility with every radio, programming cable, Bluetooth adapter, Android device, firmware version, or operating environment is not guaranteed. You should maintain backups of radio configurations before writing changes.

2. Purchase and Payment

Purchases made through pocketchirp.com are one-time purchases unless the checkout page expressly states otherwise. Payment processing, applicable taxes, invoices, and related payment services are handled through Stripe and its applicable payment services.

The purchase price provides access to the official PocketCHIRP distribution offered with that purchase and to the associated purchase entitlement and activation services described below. It does not transfer ownership of PocketCHIRP or of any third-party or open-source components used with it.

3. Activation Service

The official PocketCHIRP direct-distribution build may use a device-bound activation system. A purchase activation code may currently activate up to three devices. Re-activating the same recognized device does not intentionally consume another device slot.

This device limit applies to PocketCHIRP's official hosted activation service and purchase entitlement. It does not limit rights granted to you by the GNU General Public License version 3, including your right to study, modify, build, copy, and redistribute GPL-covered software under the GPL.

4. PocketCHIRP CHIRP Engine and GPL-3.0

PocketCHIRP uses a separate companion application called the PocketCHIRP CHIRP Engine. The CHIRP Engine contains the GPL CHIRP runtime and bundled radio drivers and is distributed separately from the proprietary PocketCHIRP application.

GPL-covered portions of the PocketCHIRP CHIRP Engine are licensed under the GNU General Public License version 3 (GPL-3.0). Nothing in these Terms is intended to reduce, override, or add restrictions to rights granted under GPL-3.0. If these Terms conflict with GPL-3.0 for GPL-covered material, GPL-3.0 controls for that material.

5. GPL Source and License Materials

Corresponding Source and applicable license information for GPL-covered components distributed by PocketCHIRP are made available in accordance with GPL-3.0. Availability may be provided with the applicable distribution, download area, or another clearly identified PocketCHIRP source location.

Access controls or purchase requirements that apply to PocketCHIRP's proprietary app, hosted services, direct downloads, or activation system do not restrict rights granted under GPL-3.0 for GPL-covered material.

6. Third-Party and Open-Source Components

PocketCHIRP may include or use third-party open-source components and data. Applicable copyright notices and license terms remain in effect for those components. Where a third-party license grants rights beyond these Terms, those rights are not restricted by these Terms.

7. Updates and Changes

PocketCHIRP may receive updates, compatibility fixes, radio drivers, interface changes, or other improvements. Features may be changed, replaced, or removed as the software evolves. A particular future feature or radio is not guaranteed unless expressly stated.

8. Radio Programming and User Responsibility

Programming a radio can alter frequencies, transmit settings, memories, firmware-visible configuration, and other device behavior. You are responsible for reviewing changes before writing them to a radio and for complying with applicable radio, spectrum, licensing, and equipment laws and regulations.

PocketCHIRP does not authorize operation on frequencies, power levels, or modes that would otherwise be unlawful or unauthorized.

9. Google Play Distribution

PocketCHIRP and the PocketCHIRP CHIRP Engine are distributed through Google Play. Google Play purchases, refunds, account services, distribution, and related transactions are additionally subject to Google's applicable terms and policies.

The PocketCHIRP CHIRP Engine is a separate companion application. Supported CHIRP-based radio programming functionality in PocketCHIRP may require that both PocketCHIRP and the compatible PocketCHIRP CHIRP Engine be installed.

10. Refunds

If you experience a purchase, download, activation, or material compatibility problem, contact support@pocketchirp.com. Refunds may be provided where required by applicable law or when otherwise approved through the applicable payment process. Nothing in these Terms limits mandatory consumer rights that apply to you.

11. Availability of Hosted Services

Download, purchase-verification, activation, recovery, update, and other hosted services may occasionally be unavailable because of maintenance, outages, security issues, or circumstances outside PocketCHIRP's control. Reasonable efforts will be made to restore affected services.

12. No Warranty

To the maximum extent permitted by applicable law, PocketCHIRP is provided without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.

This section does not eliminate warranties or consumer protections that cannot legally be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, PocketCHIRP and its contributors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, radio configuration, revenue, or use arising from PocketCHIRP or its hosted services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

14. Abuse of Hosted Services

You may not use PocketCHIRP's hosted purchase, download, activation, recovery, or other infrastructure to attack, overload, disrupt, probe, or gain unauthorized access to systems or accounts. This restriction concerns PocketCHIRP's hosted services and does not restrict lawful exercise of GPL rights in the PocketCHIRP software itself.

15. Changes to These Terms

These Terms may be updated as PocketCHIRP develops or its purchasing and hosted services change. Updated Terms will be posted at pocketchirp.com. Changes do not retroactively remove rights already granted under the GPL.
